Agreement also includes Brasil Cacau and Kop Koffe, two other brands from the CRM Group
Cade (Administrative Council for Economic Defense) approved the acquisition of the CRM Group, which owns the brands Kopenhagen, Kop Koffe and Brasil Cacau, by Nestl.
The agreement, announced in September last year, provided for Nestl to acquire the entire stake in FIP Dutch, whose shareholders are funds managed by Advent International, in the CRM Group.
In a note, the organization said that if the CADE Court does not invoke the merger act for analysis or there is no appeal filed by interested third parties, within 15 days, the decision of the General Superintendency will be final.
Also according to Cade, there are sufficient elements to rule out the possibility of Nestl exercising market power after operating in the five relevant markets with horizontal overlap.
