The Federal Supreme Court (STF) scheduled the judgment of Minister Luiz Fux’s individual decision for this Thursday (14). In the decision, the judge determined measures to prevent beneficiaries of social programs from placing bets on betting sites.
Earlier, Fux, who is the case’s rapporteur, ordered the government to adopt “immediate special protection measures” that prevent the use of resources from social and assistance programs, such as Bolsa Família and the Continuous Payment Benefit (BPC).
In the decision, the minister also banned betting advertising aimed at children and adolescents. Since the beginning of this year, Conar (National Advertising Self-Regulation Council) had already put into force ‘Annex X’, a document with self-regulation rules for betting advertising in Brazil. ‘Annex X’ emphasizes some content restrictions and advertising targeting, aiming to protect minors.
The text also provides for the need to insert the “18+” symbol or the warning “prohibited for under 18s”; prohibiting the use of elements known to be associated with the children’s universe or that may attract the attention of this group; the use of age selection tools for brand profiles (age gate); prohibiting the presence of children and adolescents in advertisements.
The process that motivated the debate was filed with the Court by the National Confederation of Commerce in Goods, Services and Tourism (CNC). The entity questions Law 14,790/2023, the rule that regulated betting online of fixed quota.
In the direct unconstitutionality action (ADI), the CNC says that the legislation, by promoting the practice of gambling, causes negative impacts on less favored social classes. Furthermore, the entity cites the growth in household debt.
According to a survey released in August this year by the Central Bank, Bolsa Família beneficiaries spent R$3 billion on bets.
