Bill 2630 should go to vote next week in the Chamber of Deputies
Scheduled to be put to a vote next week, PL 2630 has undergone an amendment to article 7 of the text, the main target of criticism. Coincidence or not, the change comes weeks after big techs have spoken out against the proposal presented so far. Google, for example, even claimed that the Fake News PL could make platforms less secure.
In the old text, the “combination of the processing of personal data of the essential services of providers with those of services provided by third parties was prohibited, when they have the exclusive objective of direct and indirect exploitation in the market in which it operates or other markets”. With the change, the sharing of personal data may take place, however, in accordance with the General Law for the Protection of Personal Data (LGPD).
“The sharing of personal data from the services of providers with those of services provided by third parties, when they have the exclusive objective of direct and indirect exploitation in the market in which it operates or in other markets, can only occur in accordance with Law No. August 14, 2018 – General Law for the Protection of Personal Data, provided that this combination does not have the object or effect of restricting competition under the terms of art. 36 of Law nº 12.529, of November 30, 2011”, reads the new text.
President of Abradi (Brazilian Association of Digital Agents), Carolina Morales highlighted the importance of relying on some legality. “There is a legal principle of the law, which is the legitimate interest, which can be used within the treatment. Why? Because we can opt-in in a first contact with the client, which, authorizing, can be kept within of the database”, he said.
Sought after, the IAB Brasil did not comment on the changes in PL 2630 until the publication of this article.
In addition to large technology companies, national and state entities launched a letter asking for the approval of PL 2630/2020. Among the entities that make up the Coalition and sign the text are Abap (Brazilian Association of Advertising Agencies), Abert (Brazilian Association of Radio and Television Broadcasters), ANJ (National Association of Newspapers), Fenapro (National Federation of Advertising Agencies), ), Outdoor Central and APP (Association of Advertising Professionals).

This Thursday (31), deputy Orlando Silva presented a new report to the Fake News PL, whose proposal is to require apps, social networks and internet providers to have companies open in Brazil. The idea is that, in this way, they are able to comply with legal decisions. According to the previous text, the platforms should only have representatives in the country.
