A federal judge in San Francisco has dismissed former President Donald Trump’s lawsuit against Twitter seeking to reinstate his banned account on the platform, according to a court filing.
The ruling is a victory for Twitter, which has asked Judge James Donato of the US District Court for the Northern District of California to dismiss the lawsuit. In dismissing Trump’s case, Donato maintained that Twitter was not acting as an agent of the US government – as Trump had claimed – when it closed his account and therefore did not infringe on Trump’s First Amendment free speech rights. “The amended complaint does not plausibly allege a First Amendment claim against Twitter,” the ruling reads.
“The Plaintiffs’ First Complaint is Rejected.” Donato also dismissed other Trump claims, such as that Section 230 — the law that protects tech platforms from lawsuits over most user-generated content — is unconstitutional. Twitter declined to comment on the dismissal of the lawsuit. Trump can continue with the case, with Donato ruling he can file an amended complaint, although the ruling also states that Trump will not be allowed to add new legal claims.
Since filing the Trump lawsuit, billionaire Elon Musk has tried to buy Twitter for $44 billion. Musk has said he wants to restore “freedom of speech” on the platform and conservatives believe Trump can be reinstated under Musk’s ownership of the platform. Trump said he will not return to Twitter even if his account is restored, highlighting his new social media venture, Truth Social.
