Recently, the Ministry of Justice and Public Security announced the suspension, for an indefinite period, of the activities of around 180 companies in the telemarketing sector, and the fine for non-compliance with the order may not come cheap. The companies are mainly linked to banks and financial institutions.
The order published in the Official Gazette of the Union is a precautionary measure that determines, throughout the country, the suspension of abusive active telemarketing services aimed at contacting the customer to offer products or services without the prior consent of the consumer, and this can only be approached by telephone if you have expressly expressed an interest in this regard.
In June, Anatel (National Telecommunications Agency) announced a three-month ban on companies that used automatic robots to make more than 100,000 abusive telemarketing calls a day, which are those that are not completed or that are automatically turned off within three seconds. This type of mass shooting, in addition to generating a high number of consumer complaints, overloads telecommunication networks without effectively promoting communication between people and companies, and can generate fines for practicing companies of up to BRL 50 million.
For the consumer, the decisions can be a relief, but the ABT (Brazilian Association of Teleservices) was concerned, claiming that the employment of more than 1 million workers could be at risk, as well as the consumer’s pocket, as the change results in higher prices by restricting competition between companies over the phone.
All this movement is related to the LGPD – General Law for the Protection of Personal Data (nº 13.709/2018, sanctioned on August 14, 2018), which came into force in August 2020, with clearer rules for those who deal with personal data, whether physical or digital. The law gives more power to the holder of this information, because the consent of the owner is considered essential.
In short, the LGPD inaugurates a new culture of privacy and data protection in the country, and measures must be taken by companies operating in the sector. The first step is to understand what can and should be done.
According to André Echeverria, a specialist in business transformation through the incorporation of emerging and disruptive technologies and CEO of Permeets, a company focused on assertiveness in digital marketing combined with data compliance, “It is necessary to reinvent the activation and identification of new customers by connecting them in real time and transferring control of your personal data to them. The result for brands is a database that is always up to date and with validated activation permissions. And users thus assume control of their privacy”.
Specialist in obtaining customer consent in an organic way, without interrupting the sales journey, the solutions offered by Permeets put companies on a new path, safer in relation to the laws and measures in force and more assertive in relation to their image before the consumers. Counting on this partnership will make the company increase the return on its investment in marketing, improve the customer experience with its brand and become adhering to the LGPD, uniting economy and compliance. It is a new paradigm in the activation model.
Companies that rely on the support offered by Permeets start to differentiate themselves from the competition in fundamental points, such as customer acquisition, accelerating their conversion cycle through opt-in with QR code; ROI digital campaigns, integrating online and offline to activate your customer from anywhere; keep their customers’ data always up to date; and ensure GDPR compliance, managing the consent of their clients.
The application of the actions also allows integration with e-commerces, CRM and applications through APIs, and the implementation is fast, based on a subscription model, which generates more return from marketing actions without hurting the LGPD. The solution is managed in the cloud and very secure for business and consumers. André Echeverria recommends:
“Permanent logging of changes made by users to their permissions, encrypted data that is always up-to-date and synchronization with DBase/CRM tools allow for personalization in the relationship with the customer. The initiative goes beyond adherence to the LGPD and demands for privacy, and can bring a definitive transformation to the image and, consequently, to the company’s profitability.”
More than a desire to accelerate their sales, companies today have needs they cannot ignore, and looking for a solution like the one that Permeets offers can be a big step in their evolution.
