Montana has become the first US state to pass legislation banning TikTok on all personal devices. Last week, the state legislature sent a bill to Governor Greg Gianforte that prohibits TikTok from operating within state borders, as well as preventing app stores from offering TikTok for download.
The legislation marks the most advanced step ever taken by a US state government to restrict TikTok due to security concerns that have been at the forefront not only in the United States, but in many countries around the world.
The result of the vote among Montana House legislators was 54-43 to give final approval to the bill, known as SB419. If Gianforte signs the bill, it will go into effect in January. However, legislation can quickly face significant legal challenges.
The protection of law specifically names TikTok as the target of the measure and outlines possible penalties of $10,000 per day for violations. Penalties would also apply to any app store that violates the law. Individual TikTok users, however, would not be penalized for accessing the app.
In a statement, TikTok hinted at possible legal action to oppose the bill:
“The bill’s supporters have admitted that they have no viable plan to operationalize this attempt to censor American voices and that the bill’s constitutionality will be decided by the courts,” said Brooke Oberwetter, a spokeswoman for TikTok. “We will continue to fight for TikTok users and creators in Montana, whose livelihoods and First Amendment rights are threatened by this flagrant government overreach.”
Various governments around the world, including the United States, have used their authority over the official devices they control to restrict TikTok from smartphones, computers, and Wi-Fi networks, but these restrictions do not extend to personal devices.
