Another stage of PL 2331/2022, which regulates streaming services in Brazil, was approved this Wednesday (22), by the Economic Affairs Committee of the Federal Senate.
With 24 votes in favor and none against, it was established that players such as Prime Video, HBO Max, Netflix, YouTube, among others, must have a minimum of national production in their catalog to operate in the country.
According to the text, the minimum reserve in the catalog must follow the total number of works available. For example: from 2 thousand titles, streaming must offer 100 national productions.
The text also establishes that platforms will be charged annually for the Contribution to the Development of the National Cinematographic Industry. The document says that the fee will be limited to 3% of annual gross revenue in case of annual revenue of up to R$4,800,000, the platform will be exempt from the tax.
The Brazilian Chamber of Digital Economy expressed, in a statement, its concern about the project that proposes rules for video on demand platforms. According to the entity, the proposal being debated today ‘does not only deal with streaming services, but includes, exclusively with a view to taxation, different types of audiovisual content published on different types of digital platforms’.
“In practice, the proposal would tax content shared by ordinary people, causing significant impacts to the free internet model, digital advertising carried out by small advertisers and remuneration of creators, without any mechanism that directs the resources collected for investments in the production ecosystem itself. of digital content”, said the entity.
