The decision followed the request of Mark Zuckerberg’s company, which pointed out that the ban could have repercussions on the availability of its services in the country
Meta, the company that owns Facebook, Instagram and Facebook, managed to suspend the court order that prevented the company from using the brand in Brazil.
On February 28, the Court of Justice of the State of São Paulo ordered Mark Zuckerberg’s company to stop using the name in the country within 30 days, but this past weekend, the American technology and social media conglomerate appealed action, which was accepted by judge Heraldo de Oliveira Silva.
According to g1, the decision met Meta Americana’s claim that the ban “could have a direct impact on the availability of its social networking services in the country.”
Context
The trouble began when the Brazilian company Meta Servios em Infortica went to court to claim the use of the name in the country, since it already held the rights to the brand granted in 2008, when the National Institute of Intellectual Property (INPI) accepted the request of the trademark registration made in 1996.
The company also stated that, due to duplicity, it had already been cited in more than 100 processes by the American company.
In contrast, the parent company of Facebook, Instagram and Whatsapp changed to the name “Meta” in 2021, in a move by the company to establish itself in the metaverse market.
