The National Data Protection Authority (ANPD) has published the regulations on the role of the Data Protection Officer.
In addition to being published in the Official Gazette of the Union, the rule was announced by the CEO, Waldemar Gonçalves, at an event in Rio de Janeiro.
“Detailing the role of the Data Protection Officer was one of our priorities due to his importance for a data-driven society. He is a key player in ensuring compliance with the fundamental right to the protection of personal data, and, consequently, in consolidating a culture of data protection in the country,” stated Gonçalves.
According to the ANPD, the Data Protection Officer is a figure created by the General Data Protection Law (LGPD) and is responsible for acting as an interface between the data subject, the processing agent and the ANPD. In addition, he or she is also responsible for guiding the organization for which he or she works in relation to best practices in data processing.
Regarding compliance with the LGPD, the regulation details aspects of the role of the Data Protection Officer, including the disclosure of their identity and contact information, the duties of processing agents and situations of conflict of interest.
In addition to providing greater legal certainty for processing operations, the regulation reflects demands from society and the regulatory process included several stages of social participation, including Subsidy Requests, Public Consultation and Public Hearing. In total, the technical area analyzed almost 1,200 contributions from more than 200 people.
