Procon-SP, on the other hand, suggested the creation of a protocol of actions against the harmful effects of games
On Wednesday (31), the Ministry of Finance established the rules for bets. With this, from 2025, the operation of online betting platforms based in Brazil should be authorized. They must be certified to offer games on the market, such as Tigrinho.
According to the rules, online gambling must be random, as is the case with slot machines, with unexpected results of symbols, figures or objects. And, in fixed odds, the game must make it very clear how much the bettor will win. And the bettor must have access to information such as: multiplication factor, i.e., how much he will win if he wins – possibilities of winning and how it is possible to win, i.e., the order of the symbols.
Furthermore, it was also defined that each game must pay out at least 85% of the prizes collected from bets to those who bet. Promises of future winnings, negative balances for bettors or forcing them to choose a certain game are prohibited.
The ordinance also clarifies what is not an online game, those that cannot be offered. These include multi-bettor games, fantasy sports and so-called peer-to-peer games, in which the agent is not involved, but merely provides the environment for bettors to play.
Procon and Conar
On the other hand, Procon-SP wants to create a protocol of actions to prevent and address the harmful practices and effects resulting from online gaming and betting in the country, from a consumerist perspective, in order to prevent over-indebtedness.
The proposal is that all entities of the National Consumer Defense System – SNDC develop integrated educational activities focused on the practice of responsible gaming, share issues and problems faced by consumers and practices of providers of these services, in order to support the adoption of public policies and appropriate measures.
Conar (National Advertising Self-Regulation Council) was another entity that, in early 2024, approved a document with the self-regulation rules for betting advertising in Brazil. The rules of Annex X had been under discussion since August 2023 and came into effect in January of this year.
The text provides, for example, for the need to insert the symbol “18+” or the warning “prohibited for under-18s”; the prohibition of the use of elements recognizably associated with the world of children and young people or that may attract the attention of this group; the use of age selection tools for brand profiles (age gate); the prohibition of the presence of children and adolescents in advertisements.
