Twitter’s lawsuit against Elon Musk over its decision to terminate its $44 billion acquisition deal will be heard on October 17 and will last five days, a Delaware judge ruled. Jude McCormick, who is overseeing the case, issued the order for trial dates on Thursday. After McCormick previously ruled in Twitter’s favor that the process could be expedited and take place in October, the two sides continued to argue over the precise start date, with Twitter pushing for it to start on October 10th.
Musk’s legal team had initially asked for the trial to take place in 2023. Twitter’s legal team argued that it was necessary to expedite the case to limit the “damage” to its business and ensure the settlement could be completed before October 24. the “dead” date on which the two sides previously agreed to close the deal.
Twitter filed a lawsuit against Musk earlier this month in the Delaware Court of Chancery in an effort to force Tesla’s billionaire CEO to abide by his deal to buy the social media company after Musk said he wanted to terminate the deal.
Musk’s attorney previously claimed that Twitter was “materially violating several provisions” of the settlement, claiming that the company had withheld data requested by Musk to assess the number of bots and spam accounts on the platform. Twitter’s legal team later called Musk’s termination attempt “invalid and unfair” and suggested in the lawsuit that Musk is using bots as a pretext to try to get out of a deal he now has buyer remorse for.
In the meantime, Twitter continues to move forward with the settlement process. On Tuesday, Twitter sent shareholders a letter saying it would hold a special virtual meeting on September 13 to vote on the merger deal.
